19. Dispute resolution and arbitration
Governing law and venue
These terms are governed by the laws of the State of Delaware, without regard to conflicts of law principles. Subject to the arbitration provisions below, the exclusive venue for any permitted court action is the state and federal courts located in Delaware.
Informal resolution
Before starting arbitration, the complaining party must send a written Notice of Dispute to
describing the claim and requested relief. The parties will try to resolve the dispute informally for 30 days.
Binding arbitration; class action waiver
Any dispute, claim, or controversy arising out of or relating to these terms or the site that is not resolved informally will be resolved by binding arbitration on an individual basis. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules if the claim is under $250,000, otherwise under its Comprehensive Arbitration Rules, in New Castle County, Delaware. If JAMS is unavailable, the American Arbitration Association may administer under its Consumer or Commercial Rules, as applicable. The language is English. The arbitrator may award any relief available in court, subject to the limitations in these terms.
No class actions or jury trials. You and Private Jets, LLC agree that each may bring claims only in your or its individual capacity, not as a plaintiff or class member in any class or representative proceeding. The arbitrator may not consolidate the claims of more than one person. You and Private Jets, LLC waive any right to a jury trial.
Small claims and injunctive relief
Either party may bring qualifying individual claims in small claims court. Either party may seek temporary or preliminary injunctive relief in court to preserve the status quo or protect intellectual property or site integrity.
Costs and opt‑out
Fees will be allocated as required by the applicable administrator’s consumer rules. The arbitrator may award fees and costs to the prevailing party where authorized by law. You may opt out of arbitration by sending a written notice to
within 30 days of first accepting these terms. If you opt out, the class action waiver still applies to the maximum extent permitted by law.
20. Export and sanctions
You may not use the site or services in violation of export control or sanctions laws. We may restrict access to the site where prohibited.
21. Changes to these terms
We may update these terms at any time without prior notice. When we do, we will revise the effective date and version above. Your continued use of the site after changes take effect means you accept the updated terms.
